Jason is a health care, data privacy, and security lawyer with 18+ years of experience in both private and government sectors. Jason has held CIPP/US certification since 2018 and is currently pursuing the IAPP’s AI governance certification. He obtained his Juris Doctor from the University of Tulsa College of Law in 2007 and was awarded a health law certificate with his doctorate.

After working with clients in the health care space in private practice, Jason served as an assistant attorney general for Oklahoma, where he focused on health care law enforcement, policy, litigation, and data privacy. He has since gained diverse legal experience across the country, working as in-house counsel to major health systems, global medical practices, and health data-driven companies. Jason’s expertise includes HIPAA compliance, fraud, waste, and abuse law compliance, data privacy and security, AI governance, international data transactions, and the commercialization of anonymized and protected data. Jason also provides advice and counsel on data governance and compliance program creation and implementation.

Representative Matters

  • Advised a publicly traded health care entity on establishing an AI governance program, including vendor oversight and contract compliance controls.
  • Advised a large health system on the offshoring of departments, including the exchange of protected information outside of the U.S. in a compliant manner.
  • Advised on the development and implementation of a bioinformatics program for a publicly traded health care company.
  • Advised on the development of a Privacy-by-Design program (PbD) for a publicly traded health care company.
  • Developed and implemented HIPAA compliance program with a publicly traded health care company, including employee training materials.
  • Developed a CCPA compliance program for a national health system.
  • Assisted several software and health care companies with creating data-leveraging strategies and developed data governance programs.
  • Developed and implemented comprehensive HIPAA data breach compliance programs for several health care systems.
  • Advised several health care entities on data exchange compliance programs and sub-processor vendor oversight compliance programs.
  • Restructured 42 C.F.R. Part 2 compliance program for a large health care system.
  • Developed a comprehensive contracting compliance program, including policies and procedures for services, goods, employment, and professional services agreements for a large health care system.
  • Restructured contracting compliance program and telemedicine program for a health care entity with seven long-term health care facilities.
  • Developed and implemented a business associate compliance program for a state-run health system.
  • Advised numerous health care entities and state agencies on data privacy and security compliance, including data breach response, data governance policy, and implementing best practices.
  • Advised numerous providers and health care entities on professional licensing and credentialing compliance requirements.
  • Participated with multiple state and federal agencies in a task force to reduce and eliminate improperly prescribed opioids in the state of Oklahoma, resulting in numerous successful civil, criminal, and administrative actions against various health care entities and providers.
  • Successfully brought numerous complex declaratory judgment actions over coverage disputes ranging from homeowner’s, commercial general liability (CGL), directors and officers (D&O), and errors and omissions (E&O) policies, regarding asbestos injury, foreign imports, class action litigation, defective securities issuances, cyber liability, and construction defect disputes.
